Hi there,
The court cannot be act on its own because it is controlled by the legislature. This means that the state forms the legislature and requires an authority to express it in terms of mishaps. The court listens to the people and formulates decisions exercising the legislature provided to them. The court cannot formulate its own opinions and certainly cannot practice those as it it would be considering going against the law state has provided.
