J and K has its own constitution because at the time of partition of India pt Jawahar lal Nehru, Mahatma Gandhi nd all other national leaders were trying to merge all the small kingdoms into a single nation. there were about 565 states in India at that time. all other kings agreed but Maharaja Hari Singh, ruler of j nd K refused to merge either with India or Pakistan.
Pakistan attacked j nd K with the help of a tribe called kabaili. maharaja's army wasn't enough to defend the state,so he asked for help. pt Jawahar Lal Nehru agreed to help but only when j nd K will merge in India. Hari Singh agreed to his demand but he wanted that special rights should be given to j nd K. So article 370 was passed to give special rights to j nd K.

Under Part XXI of the Constitution of India, which deals with "Temporary, Transitional and Special provisions", the State of Jammu and Kashmir has been accorded special status under Article 370. ... Union Legislature has very limited jurisdiction in case of Jammu and Kashmir in comparison with other states.
