oxygen is both a liquid and a gas - it is a gas on Earth because it is in a gaseous state, i.e. the physical state of any element like oxygen depends on the ambient temperature and pressure. Because Earth's atmosphere doesn't pressurize oxygen enough to turn into a liquid, it stays a gas. Nor is it cold enough on earth to condense oxygen into a liquid. (On Mars, oxygen is a liquid!)
