N in HNO3 is in the +5 oxidation state
That +5 is the highest oxidation state for N.
Since N has the highest oxidation state it can not be oxidised any more, N is therefore an oxidizing agent for this particular reaction.
One more reason is that each molecule of HNO3 has 3 O atoms which is a very good oxidising agent.
So.. HNO3 is an oxidizing agent because the N can be readily reduced and it contains more O
