Why the cooper pairs are formed only near the fermi surface?

The reason is straightforward: due to the exclusive principle electrons inside the Fermi sea do not respond to the electron-phonon interaction and therefore do not experience phonon induced attraction to form pairs. The fermi ground state and BCS ground states almost concide hence Cooper pair formed near Fermi surface.
