Why the surface water of ocean become ice and under water remains assuch?

When the surface water in the oceanfreezes (when it is cooled by very cold air above) the ice that is formed is less dense than the seawater below for two reasons: mostly because ice is about 10% less dense than water, and secondarily because salt is mostly excluded from the frozen ice.
