ARTICLE 35A AND ARTICLE 370

Date: 9 August 2019

Our constitution provides everyone with freedom and equality but somewhere, this freedom and equality seemed vague when it came for Jammu and Kashmir. This state though a part of India had a separate law system and not much of our laws were applicable on the state and this was provided under Article 370 of our constitution. Article 35A made the provision for the residents of the state and mentioned special privileges to them. Now, these articles have been removed by the present government and this has provided people with the opportunity of being one with the state of Jammu and Kashmir.

Answer:

                Articles 35 A and 370

Articles 35A and 370 were constitutional provisions that gave the state of Jammu and Kashmir a special status. The first thing to be noted about these articles were that they were temporary provisions. Some of the special privileges granted to residents of Jammu and Kashmir were:

1. No one from any other part of India could buy land in Jammu and Kashmir.

2. All laws passed in Indian Parliament could not be applied to Jammu and Kashmir.

3. Kashmiris could have their own constitution and flag.

4. Only residents of J & K could take part in electing the state Government.

5. Any lady who married outside the state would lose all rights.

The bitter truth is the people in power in J&K used these articles for their vested interests. As a result J & K became hub of terrorism and religious fanaticism.

However, on August 5, 2019 the Indian Government under the leadership P.M. Modi and Home Minister Amit Shaw, the bills abrogating these articles were passed with majority in both the houses of the Parliament.
