In India the Consumer Court is a special purpose court which handles all the cases related to consumer conflicts, grievances and disputes. The government has set up judiciary hearings in order to protect the rights of the consumers. Its is established in order to maintain the fair contracts and practices by sellers. A consumers can lodge a case against a seller if a buyer thinks that he/she has been duped or exploited by sellers.
The court can only pass a judgement in the favor of the consumer/customers only if he/she can provide with the proof of exploitation, like purchase memos or bills. Incase the consumers does not have proper documents to put forward his/her grievances it becomes difficult for them to file a case or even win.
The two utmost requirements for filing a complaint by a consumer are
- First identify the Jurisdiction of the Forum where one can file a case. This can be identified from two aspects of jurisdiction . Like Territorial and Pecuniary. The Consumer must take into account both the pecuniary as well as territorial jurisdiction of the tribunal before filing his/her complaint and even need to select the correct forum.
- Buying a copy of the Consumer Protection Act and drafting one`s complain in a clear and concise manner. This should be supported with the mandatory documentation. Photocopies all the documents supporting your grievances should be attached as a proof of evidence. Documents include copy of the purchase bill along with its warranty and guarantee documents. Also a copy of any communication with the trader in respect of requesting him to replace or rectify the product.
