The Council of Ministers is constituted by the Prime Minister of India. The President has no role in it.
The 42nd Amendment Act of 1976 and 44th Amendment Act of 1978 have made it compulsory for the office of the President to follow the advice of the Council of Ministers.
Very limited discretionary powers, in certain cases, now rest with the President otherwise he is bound to follow Council of Ministers.
Even the President can be impeached if he or she does not go by the advice of the Council of Ministers.
Now, it is also clear as to why the President of India is called the titular head or just a rubber stamp.
