If the court functions correctly, and a verdict is sustained on appeal, it

adequately ascertains the essential facts of a case and correctly applies applicable law. The existence of appellate courts clearly demonstrates that trial courts do err in their findings and application of legal remedies, even though they act in good faith. The object of trial proceedings is two-fold: to protect public interest by the verdicts found and to serve as a probative lesson to the general public. Neither of these functions can succeed if legal proceedings are corrupted by malfeasant or incompetent court officers, especially if they are unrecognized or unremedied in a timely manner. As Justice Holmes once remarked, justice delayed is justice denied. The Courts cannot and should not cater to public sentiment in their actions but they must be justifiably regarded as good faith arbiters of the public interest. If the Courts fall into disrepute because of arbitrary or destructive actions, society has a very serious problem because Courts, as a last resort, prescribe the limits of public behavior.
