Right to own property or real estate was our original Fundamental Right given by The Constitution of India.  In 1975 it was taken back,  and now in compliance with Article 300A, property rights are granted as constitutional right. Thus, government does not require land procurement law or legislation which enables it to acquire any property or shelter in India by means of prerogatives. The right to shelter is a constitutional right, the right to all the infrastructure required for human life and development

Explanation:

  • Unfortunately, in the last so many years many governments have not provided any budget allocation for shelter needs." Phonic declarations & vision execution" are made to draw interest without any action plan. Poor people live in  slums and villages in which they have not even achieved drinking water or electricity.
  • Hence shelter for a human being is  a place  where one grows physically, intellectually, mentally, & spiritually. Accordingly, shelter rights include an "adequate living space", "safe, decent structure", "clean & decent environment", "light", "fresh air& water", electricity, "sanitation & other civic amenities" such as roads, etc., in order to provide simple accommodation.
  • Consequently, the right to shelter does not mean the pure right to a roof, but the right to all the facilities required to allow them as a human being to survive and thrive. The right to shelter would be considered as a human right because it is seen as an integral condition of the right to live. As laid down in the "Directives Principles of State Policy", the State shall, necessarily under its economic policy, be deemed obliged to guarantee it for its citizens.
  • As a member of an "organised civil community", in a "democratic society", one must have a "permanent shelter" , in order to physically ,intellectually, & mentally equip one another as a good citizen, as required by the "fundamental duties , and an "useful citizen" & "equal participant" in "democracy". Hence citizens can play an active role in democarcy of the nation
  • Public participation in general requires and encourages the involvement of those who may be impacted or involved in a decision. This can refer to individuals, states, organizations, corporations or all other public interest bodies. The principle of democratic engagement is that policy makers are entitled to engage in the decision-making process. Public participation ensures that the contribution of the people will affect a decision. Public Participation should be seen as an opportunity and a central aspect of democratic governance
  • The main aim of making a "individual equipped" with a "right to dignity", which is an important feature of democracy,  & equal treatment is to make him a cultural being. The very aim of the constitutional framework of the "economic justice', "right to equality", "fundamental right of residence", dignity of the individual and the "right to live on itself", is therefore "frustrated" without a "decent shelter".
