Two Principles that define the rule of law in South Africa;

  1. The principle of supremacy of the law - this means that the pre-dominant law is supreme and no person can be deprived of his or her rights through the arbitrary exercising of power. It is therefore clear that a person's rights can only be deprived only in terms of pre-dominant law.
  2. The principle of equality under the law - This principle clearly outlines that no person whatsoever is above the law. Every member of the public including the nobles and public officials are subject to ordinary law, thus ordinary courts emphasize execution of this principle.

The topic that was asked to address in a meeting on the subject called  ‘The Rule of Law in South Africa. This is based on two principles viz.

1.Measuring Performance and

2.Meeting Standards  .

It essentially demonstrates the role and responsibility of the judiciary in promoting peace, good government and sustained economic growth and development of the country.

And at the origin of it is the observation of the rule of law, which was framed by  Constitutional Court of South Africa.
