Create your selection on a layer.

Select a fill color as the foreground or background color. Choose Window→Color. ...

Choose Edit→Fill. The Fill dialog box appears. ...

Click OK. The color that you choose fills the selection.

background layer

The background layer is a special and always appears add the butter and it is created automatically when you create a new image and image can have only one background layer is present behind all the other layers and you cannot change its position you cannot do it it more it contains or change the cassity but you convert it into regular layer all the other layer around you added which appear above the background layer.
