Reservation is an act of making an exception for few."A quota system where percentage of seats are shared in governments (State & Central) and Educational Institutions". It is considered by many as an instrument to uplift the, social, economically backward classes, under represented groups (may be in accordance with Caste and Gender). Reservation system is made as an affirmative action, a positive Discrimination.

However, let’s imagine two people. One is a neurosurgeon and performs your surgery which requires great skill and the other is a doctor who sits at his clinic and prescribes medicine for your cold. The fact that, maybe, the difference between their capability is judged merely by a minority or caste certificate speaks for itself. Visualising the situation makes things real and serious enough to give them a thought. In present reservation system can, in fact harm the economic structure of the country and create social disharmony.

Let me start from the reservation in Indian Armed Forces.

Someone has very beautifully quoted, “Our Flag does not fly because the wind moves it. It flies with the last breath of each soldier who died protecting it.”

Indian Armed Forces consists of 3 wings:

Indian army ( Bharatiya Sasastra Sena)

Indian Airforce (Bharatiya Vayu Sena).

Indian Navy (Bharatiya Nausena).

The answer with regards to Indian army could be two-fold. One, Hierarchy of Indian Armed Forces is very very firm. In few cases, they even dare to refuse Government to give reasons (Army General J.J. Singh honestly refused to give a headcount of Muslims serving Indian army to Sachar committee saying such census could be dangerous to the organisation). Two, In a wider view “someone ready to take a direct bullet for the country shall not be differentiated among castes and religions.” - (IPS officers do take bullets but the hierarchy of Indian Police Service is not very rigid as Indian army).

However, Indian Army is could not completely deny reservation for the following:

Reservation in regards with age relaxation.

6% reservation for class C and Class d posts in Indian army.

Comparatively less fee for the application.

Reservation on grounds of merit.

Now, coming to Civil Services Exam,

Mostly in Educational Institutions and Services (jobs) reservation is provided on the basis of social and Educational backwardness.

UPSC follows the Reservation policy as per the government rules.

There is flexibility in the eligibility criteria for the reserved caste. such as, The age limit for different sections is as follows:

For General - 21 Yrs - 32 Yrs or maximum of 6 attempts.

For OBC - 21 Yrs - 35 Yrs or maximum of 9 attempts.

For SC/ST - 21 Yrs - 37 Yrs No limit on attempts until the age of 37 Yrs.

Those who are considered Group 'A'/Class I officers of the All India Central and State Services (Direct Recruits) or those who are considered Group 'B'/ Class II officers of The Central and State Services (Direct Recruitment) or those who are employees in the public sector are excluded from reservation system for OBC’s.

The term ‘creamy layer’ is applied with OBC Category candidates. It doesn’t come into the picture when the candidate is an SC/ST. This is the constitutional system vouched by the Supreme Court of India.

On other hand, Not all SC/ST’s are socially and economically weak and not all upper castes are economically strong in today’s world. Many people of lower castes have stepped up the social ladder and are now on an equal footing with the ‘general’ population. On the other hand, many upper castes are still suffering from poverty and illiteracy. As a result, continuation of this idea in practice is leading to quality compromise.

Current parameters of reservation has become outdated and shallow. Present system is certainly upholding inequality of rights of citizens. It is the high time for the government to take effective measures to enact a generic law in providing reservation. Right Action at right time takes our nation to a glorious height.
