Explanation:

• The Chairperson and each Member if the Competition Commission shall hold office as such for a  period 5 years from the date on which he is appointed to his/her office and both the Chairperson and the members shall be eligible for reappointment, provided that they shall not hold office after he/he has attained 67 years in the case of the Chairperson or 65 years in the case of the Member.
• A vacancy that happens because of the removal/resignation of the Chairperson or any Member under Sec. 11 or by death/otherwise shall be filled by fresh appointment as per the provisions of Secs. 8 and 9.
• The Chairperson and each Member if the Competition Commission shall, prior to entering  his/her office or taking up his/her role, make and subscribe, in the manner, form and before the authority, to an oath of office and of confidentiality that is prescribed.
• In case of a vacancy the Chairperson's office  because of his/her death, resignation or other reasons, the senior-most Member will function as the Chairperson till the time a new Chairperson is appointed to fill such vacancy as per the Provisions of the Act.
• When the Chairperson is not in a position to discharge his/her functions because of illness, absence or any other reason, the senior-most Member shall discharge the Chairperson's functions till the time the Chairperson resumes the charge of his/her function .
