A writs is a formed written order issued by a court . Any warrant , orders , directions , and so on , issued by the supreme court and or the High court are called writs .

There are five types of writs :-

1) Writs of Habeas Corpus ,
2) Writs of Mandamus ,
3) Writs of Qua-Warranto ,
4) Writs of Prohibition ,
5) Writs of Certiorari .

WRITS

Writs are the order from the courts to lower courts, authorities or organisations. They are vested under article 32 for Supreme Court and under article 226 for the High courts.


Basically article 32 and article 226 are constitutional remedies. In case a person's fundamental rights are violated he or she can move to the Supreme Court and the High courts under these articles respectively .


The  Supreme Court  and High courts ensures that rights of the persons are secured by filing Writs.


THERE ARE 5 KINDS OF WRITS:

  • Habeas corpus - This is the order of the court to bring the detained or arrested person before itself. And if the grounds of arrest are not reasonable then it can order for release of the person .
  • Prohibition - This is ordered by the higher courts to the lower courts to drop the case when it hears a case beyond its jurisdiction .
  • Mandamus - This the order of the court to the office holder to do his job properly of he is not doing or doing the part of his work ina way that infringes the rights of the others.
  • Quo warranto - This the order of the court to show by what authority a person is holding the office ( if court suspects the person not capable of holding that position)
  • Certiorari - It is order of the higher court to the lower court or authority to transfer the case pending before it to the higher court.
