There is no binding international law that defines what is not a fair trial; for example, the right to a jury trial and other important procedures vary from nation to nation.

A fair trial requires the following conditions to be fulfilled :-

1. The accused is given or copy each of the charge sheet the FIR and the statements based on which the charge has been framed.

2. The trial is held in open court ( court which can be attended by the public including the relatives and Well wishes of the accused ).

3. The trial is held in the presence of the accused.

4. The accused is defended by a lawyer.
