Right to property was never in the Indian fundamental rights. The law (interpreter of the constitution which gives fundamental rights) only says that an Indian citizen cannot be denied right to buy property in any part of India by reason of region, religion, caste, skin colour etc. This too has got some specified exceptions.
You have no right per-se to property. You cant for example, just walk into an unused land and demand that you be registered as the owner.
But shelter is different. Recently the supreme court based on piece of public interest litigation has RULED that it is the state's duty to provide night shelter for it's homeless citizens and it will take the appropriate government department to task as and when cases are brought to it's notice.
